Before using this website or placing an order through it, you consent to be bound by these Conditions and by our Privacy Policy, Cookie Policy, Legal Notice, and General Terms of Use; therefore, if you do not agree with all of them, you should not use this website.

On the other hand, the user, who purchases the products offered through the website and whose identifying data are provided directly by him/her by entering his/her data in the different forms that CARLES FONTFREDA, S.A. makes available to access any of the products offered on the website. The information and personal data provided will be processed in accordance with the provisions of the Privacy Policy and the Cookie Policy.
Accessing, browsing, and using the website confer the user status upon the individual, and therefore, from the moment they start browsing it, they accept all the Conditions established herein and any subsequent modifications, without prejudice to the application of the corresponding applicable legal regulations. The user declares to be over 18 years of age and to have legal capacity to enter into contracts through this website.
3. PURCHASING PROCESS
The user can make purchases through the website using the methods and forms established. To do this, they must follow the purchasing procedure during which they can add to the cart, basket, or final shopping space all the products and/or services they consider. The user must complete and/or verify the information requested at each step in order to execute the purchase and corresponding shipping/delivery. Subsequently, the user will receive an email confirming that their order or purchase request has been received, which will be considered as confirmation of the order placed. At the time of purchase, the user acknowledges being aware of and accepting the specific conditions of the product and/or service in question, including, but not limited to: name, weight, price…
4. AVAILABILITY
CARLES FONTFREDA, S.A. informs the user that the number of available units of the offered products is updated according to the stock in the warehouse and the availability for sale. Under no circumstances will CARLES FONTFREDA, S.A. intentionally offer more units for sale than are available.
Please note that all orders will be shipped within the limits of available stock. In case of stock shortages or temporary unavailability of a product, CARLES FONTFREDA, S.A. will send an email notifying the user of this situation and the new recommended delivery time for the purchased products.
If the product is not available after the order has been placed, the user will be informed by email and may choose between receiving another product with similar characteristics or canceling the order.
Partial cancellation of the order due to lack of availability will not result in the total cancellation of the order, unless the user expressly requests it. This is without prejudice to the right of withdrawal.
5. PRICES
The prices applicable to the user’s contracting of products will be those listed on the website at the time the user accesses the specific product and initiates the contracting process. The prices on the website include VAT but exclude shipping costs, which will be added to the total amount due. Additionally, these prices are subject to other charges established in these conditions in a specific section on shipping cost policy.
In case of an error in the price of products contracted by the user, we will inform you as soon as possible and give you the option to confirm the order at the correct price or cancel it. If we are unable to contact you, the order will be considered canceled, and any amounts paid will be fully refunded.
CARLES FONTFREDA, S.A. reserves the right to modify the list of prices published on the website as deemed appropriate. In any case, this will not apply to products contracted prior to the modification.
6. PAYMENT METHODS
We accept payments via credit or debit card (Visa, MasterCard, American Express) and bank transfer to the account number indicated. Payment must be made at the time of purchasing the product or service.
7. RIGHT TO CANCEL THE ORDER
CARLES FONTFREDA, S.A. guarantees users the possibility to cancel their order at any time and at no cost, provided that the cancellation is communicated before the order has been made available to the carrier for shipping. To request this, it is necessary to contact CARLES FONTFREDA, S.A. via email at comandes@fontfredapintures.com or by calling 972 262 926.
8. RIGHT OF WITHDRAWAL AND HOW TO EXERCISE IT
If you are contracting as a consumer and user, you have the right to withdraw from this contract within 14 calendar days without justification. The withdrawal period will expire 14 calendar days from the day you or a third party indicated by you, other than the carrier, acquires physical possession of the goods or, in the case of goods that make up your order are delivered separately, 14 calendar days from the day you or a third party indicated by you, other than the carrier, acquires physical possession of the last of these goods.
To exercise the right of withdrawal, you must notify CARLES FONTFREDA, S.A., at Av. Antoni Gaudí, 23, 17800 Olot (Girona), by phone at 972262926, or by email at comandes@fontfredapintures.com. To meet the withdrawal deadline, it is sufficient that the communication regarding your exercise of this right be sent before the corresponding deadline expires.
In case of withdrawal on your part, we will refund all payments received from you that correspond under these Conditions and without undue delay and, in any case, no later than 14 calendar days from the date we are informed of your decision to withdraw from this contract.
We will proceed to make said refund using the same means of payment used by you for the initial transaction unless you expressly indicate otherwise, detailing the payment method through which you wish us to make the refund. You will not incur any expenses as a result of the refund. However, we may withhold the refund until we have received the goods, or until you have provided proof of return of the goods, depending on which condition is met first. In no case will the shipping costs of the order be refunded.
Unless you return the goods in a store, you must bear the direct cost of returning the goods. You will be solely responsible for any decrease in the value of the goods resulting from handling them beyond what is necessary to establish their nature, characteristics, and functioning.
Your right to withdraw from the contract will apply exclusively to those products that are returned in the same condition as you received them. No refund will be made if the product has been used beyond mere opening, of products that are not in the same condition as they were delivered, or that have suffered any damage, so you must handle the product(s) carefully while they are in your possession. Please return the item using or including all its original packaging, instructions, and other documents that may accompany it.
You will not have the right to withdraw from the contract for products or services that are personalized and/or tailored to your specific needs.
After examining the item, we will inform you whether you are entitled to a refund of the amounts paid.
If we receive an item outside the stipulated period, in poor condition, with incorrect content, or which ultimately does not meet the criteria for withdrawal from the contract, you will not be entitled to a refund. We will contact you, and if after two (2) months from when we made the item available to you it has not been collected or you refuse to receive it, we will not be held responsible, and it will be considered abandoned.
We will be authorized to pass on the corresponding costs if we can manage the return of the package to your attention. Rights and actions recognized by current legislation remain unaffected in any case.
9. SHIPPING AND RETURNS
9.1. Shipping Costs
Your order may qualify for free shipping if you make a purchase equal to or greater than 69 euros in the Peninsula (Spain, Andorra, and Portugal) or equal to or greater than 149 euros in the Balearic Islands, Canary Islands, and European Union (Countries within the EU include: Czech Republic, Netherlands, Luxembourg, Italy, Denmark, Belgium, Austria, Germany, France – excluding Corsica). *Free shipping will not be available to the rest of the European Union (EU). For orders below this amount, shipping costs will depend on the weight and volume of the order, calculated automatically during the purchase process.
**For products in the “Skirting Boards and Mouldings” category from the Orac Decor brand, free shipping will be offered for purchases over 149 euros.
***Shipments will not be made to the United Kingdom or to Ceuta and Melilla.
9.2. Shipping Zones
CARLES FONTFREDA, S.A. can ship your order to Spain (Peninsula, including Andorra and Portugal), the Balearic Islands, the Canary Islands, and the rest of the EU. At the moment, shipments will not be made to Ceuta and Melilla or the United Kingdom. You can also pick up your order online at our physical stores in Olot (Av. Antoni Gaudí, 23, 17800 and C/ Sant Esteve, 26, 17800, the latter for Fine Arts products), Figueres (Plaza Europa, 8, 17600), or Vic (C/ d’Olot, 2, 08500) at no additional cost during the stores’ opening hours. We will communicate the availability of the order via email once it is ready.
9.3. Delivery Timeframes
Delivery times are indicative, although there is a commitment to compliance. Deliveries to the Peninsula (Spain, Andorra, and Portugal) and the Balearic Islands will be made within 72/96 hours following purchase on business days (provided the products are in stock). Deliveries to the Canary Islands and the rest of the EU will be made within 5 days following purchase on business days (provided the products are in stock). For orders containing products categorized as specific, deliveries will be made within 3 weeks for the entire order). No orders will be dispatched on public holidays (national, regional, and local holidays in Olot) since our warehouse will be closed.
An informative email will be sent when the order is ready to be shipped, at which point the order status will be completed.
For orders picked up at a Fontfreda store, the pickup time will be within 72/96 hours once an email is received indicating that the order is complete and ready for pickup at the store.
Large orders (more than 3 paint buckets) will be palletized for shipment. This type of shipment takes approximately 4/5 business days and does not include tracking. Delivery will be considered complete once the carrier delivers the shipment and the delivery receipt is signed. Delays will not result in order cancellation or any compensation.
9.4. Usual Delivery Timeframes for Out-of-Stock Products
The units and availability shown on our website are indicative. If we do not have the requested stock or if they are products we have categorized as specific, the delivery time may increase up to 3 weeks.
10. RETURNS
We accept returns within 14 calendar days from the date of delivery, always subject to our prior authorization, confirmed by email (comandes@fontfredapintures.com) or another means. We will not accept returns of products that do not have their original packaging or have been manipulated. For items that have been ordered, manufactured, or customized to the customer’s specifications, CARLES FONTFREDA, S.A. reserves the right not to accept the return. This will always be the case for custom-mixed paint colors.
Amounts paid for products returned due to defects or flaws, if they exist, will be fully refunded, including delivery/shipping costs incurred to deliver the item to you and any costs you incurred to return it to us. If the return is for another reason, the customer will be responsible for the return cost, which will be deducted from the refund amount. Shipping costs, if any, will not be refunded.
For orders with an initial shipping cost equal to or greater than 69 euros to the Peninsula or 149 euros to the Balearic Islands, Canary Islands, and European Union (EU) (minimum order for free shipping), the customer wishing to make a return will be responsible for the shipping costs (provided the reason for the return is not due to a defect or flaw).
11. WARRANTIES
If you are contracting as a consumer and user, you are entitled to corrective measures, free of charge, in case of non-compliance of goods. We offer guarantees on the products we market through this website, under the legally established terms for each type of product, therefore responding to non-compliance that manifests within 3 years from the delivery of the product.
Products will be deemed compliant with the contract as long as (i) they conform to the description provided by us and possess the qualities we have presented on this website, (ii) they are suitable for the ordinary uses to which products of the same type are intended, and (iii) they present the usual quality and performance of a product of the same type that is fundamentally expected. In this regard, if any of the products are not compliant with the contract, you must notify us through the specified communication channels.
